California’s Assembly Bill 495, called the “Family Preparedness Act” of 2025, is turning heads across the country as it allows non-family members to take over the medical and educational decisions of minors without parental consent or background checks.

Democrats and mainstream media outlets are portraying the bill as a way to “streamline” the process for “temporary guardianship” and “caregiver arrangements” for children in response to an increase in youths being separated from their parents due to illegal immigration enforcement.

The “new process for short-term guardianship” allows non-relatives to become temporary guardians of minors by filling out a simple form that does not require any background check or informing the parents.

The Christian Broadcasting Network reports, “The affidavit requires would-be caregivers to indicate they have either ‘advised the parent(s) or other person(s) having legal custody of the minor of my intent to authorize medical care, and have received no objection’ or were ‘unable to contact the parent(s) or other person(s) having legal custody of the minor at this time, to notify them of my intended authorization.’”

The child’s real parents would still be allowed to make medical and educational decisions for their offspring, but the bill would also allow any “caregiver” who “signs the affidavit” to “have the same rights to authorize medical care and dental care for the minor that are given to guardians.”

California journalist Amy Reichert sounded the alarm on social media, calling the bill “a predator’s dream.”

California Pastor Jack Hibbs has been calling out the bill at his Chino Hills church and online, warning citizens to leave the state if it becomes law.

“California’s AB 495 is the most dangerous bill we’ve ever seen—and it’s being pushed right now by lawmakers in Sacramento,” he wrote. “This bill would allow any non-related adult, a neighbor, teacher, ex-relative, or even a complete stranger, to take custody of your child without your knowledge or consent. No background check. No court order. No parent’s signature. Just a piece of paper. We’re calling on every parent, grandparent, and concerned citizen to show up on August 19 at the Capitol steps in Sacramento. This is the hill to die on. Your attendance matters!”

AB 495 passed the state Assembly and will be heard in the Senate Appropriations Committee later in August.
