Image Credit: Steve Pfost/Newsday RM via Getty Images | DHS An illegal alien from Guatemala is facing significant charges in New York for allegedly raping a 5-year-girl who required surgery to repair injuries she sustained in the heinous attack, authorities say.
The shocking incident unfolded in Suffolk County on Feb. 1, but details about the investigation were just revealed on Monday.
On that day, the mother of the victim went to work and left the child in the care of 27-year-old Carlos Aguilar Reynoso, according to the Suffolk County District Attorney’s Office (SCDA).
When the mother returned, she detected abnormal behavior from the girl and found blood in her underwear, at which time the victim reportedly claimed that Aguilar Reynoso had “put his privates in her.”
The mother asked a friend to bring her and the child to a local hospital where medical professionals “determined that the child was still actively bleeding and had sustained internal injuries that required specialized medical care,” SCDA explained in a press release.
A sexual assault forensic evaluation was conducted at a specialized children’s hospital in New York City and the victim underwent surgery to repair injuries to her genital area.
After evidence was analyzed and a DNA profile obtained, Aguilar Reynoso was arrested by the Westhampton Beach Village Police Department on Feb. 2.
“Unfortunately, despite Reynoso’s tenuous ties to New York State as an alleged Illegal Alien pursuant to federal statute, Endangering the Welfare of a Child is not bail-eligible under New York State Bail Reform statutes, meaning prosecutors cannot even ask for bail,” SCDA stated.
“Moreover, under New York’s 2020 ‘Protect Our Courts Act,’ federal immigration agents could face arrest themselves if they were to seek to apprehend Aguilar Reynoso at the courthouse after his release. In fact, the Protect Our Courts Act purports to prohibit immigration arrests ‘while going to, remaining at, or returning from’ a court proceeding.”
SCDA arranged for local police to issue a Desk Appearance Ticket for Aguilar Reynoso, enabling Immigration and Customs Enforcement (ICE) to quickly take him into custody for “illegally entering the United States.”
Amid an ongoing investigation, Aguilar Reynoso was transferred from ICE custody to Suffolk County and arraigned on Mar. 23 on the following charges:
- Predatory Sexual Assault Against a Child, a Class A violent felony
- Rape in the First Degree, a Class B violent felony
- Sexual Abuse in the First Degree, a Class D violent felony
- Endangering the Welfare of a Child, a Class A misdemeanor
- Resisting Arrest, a Class A misdemeanor
Aguilar Reynoso was ordered held without bail and faces up to 25 years or life in prison if convicted.
On Friday, Department of Homeland Security spokeswoman Katie Zacharia confirmed Aguilar Reynoso is in the U.S. illegally.
The Guatemalan is due back in court on April 27, 2026.
