WASHINGTON, D.C. (LifeSiteNews) — Republicans have proposed legislation to federally ban underage gender transition procedures across state lines with the backing of the Trump Department of Justice.

Introduced by Republican U.S. Rep. Bob Onder of Missouri and Republican U.S. Sen. Marsha Blackburn of Tennessee, the Victims of Chemical or Surgical Mutilation Actdeclares that “No healthcare professional, physician, hospital, or clinic shall, in a circumstance described in subsection (b), participate in the chemical or surgical mutilation of a child” except for certain exceptions backed by “clear and convincing evidence.” 

Exceptions would include “individual(s) with biological sex characteristics that are inherently ambiguous” (such as hermaphroditism); “treatment of any infection, injury, disease, or disorder that has been caused or exacerbated by the performance of an intervention”; any “physical disorder, physical injury, or physical illness that would, as certified by a physician, place the individual in imminent danger of death”; or treatment to detransition back to one’s true sex. 

Per the limits to Congress’ enumerated powers under the Constitution, the mutilation would have to either occur in the District of Columbia (or other U.S. territory under direct federal jurisdiction) or implicate “interstate or foreign commerce” in some way, such as the patient, physician, money, or equipment crossing state lines. 

The prohibition would be enforceable by civil suits brought by any “individual subjected as a child to (prohibited) chemical or surgical mutilation” or their parents. Monetary compensation “includes, but is not limited to, compensatory damages, including all economic damages associated with undoing, correcting, or ameliorating the effects or results of any chemical or surgical mutilation procedures, and noneconomic damages for emotional distress and pain and suffering. Punitive damages may also be awarded if the claimant proves by clear and convincing evidence that the defendant against whom punitive damages are sought acted maliciously, intentionally, fraudulently or recklessly.”

“The Department of Justice has heard from far too many families who have been devastated by mutilative medical procedures that fly in the face of basic biology,” U.S. Attorney General Pam Bondi said in support of the measure. “While we continue our ongoing legal battle to protect children, we appreciate our colleagues in Congress who are working diligently alongside us to end these abusive procedures once and for all.”

The bill is likely to easily pass the House of Representatives, but to reach President Donald Trump’s desk and become law, it would need 60 votes in the narrowly divided Senate, an uphill battle.

Upon Trump’s return to office, one of the earliest executive actions was an order that ends all federal financial support for “transition” procedures on minors, rescinds or amends all of the Biden health bureaucracy’s past endorsements of underage “transitioning,” and calls for a review of the medical literature on the subject, enforcing all existing restrictions on underage “transitioning,” and taking regulatory action to “end” the practice to the greatest extent possible under current law.

Fifteen states are currently challenging the Trump administration in court over its efforts, but they have yet to secure an injunction, resulting in numerous hospitals and health systems agreeing to cancel or at least suspend their so-called “gender-affirming care.”

large body of evidence shows that “affirming” gender confusion carries serious harms, especially when done with impressionable children who lack the mental development, emotional maturity, and life experience to consider the long-term ramifications of the decisions being pushed on them, or full knowledge about the long-term effects of life-altering, physically transformative, and often-irreversible surgical and chemical procedures.

Studies find that more than 80 percent of children experiencing gender dysphoria outgrow it on their own by late adolescence, and that even full “reassignment” surgery often fails to resolve gender-confused individuals’ heightened tendency to engage in self-harm and suicide – and may even exacerbate it, including by reinforcing their confusion and neglecting the actual root causes of their mental strife.

Many oft-ignored detransitioners, individuals who attempted transitioning before regretting it and returning to life as their true sex, attest to the physical and mental harm of reinforcing gender confusion, as well as to the bias and negligence of the medical establishment on the subject, many of whom take an activist approach to their profession and begin cases with a predetermined conclusion that “transitioning” is the best solution.

“Gender-affirming” physicians have also been caught on video admitting to more old-fashioned motives for such procedures, as with a 2022 exposé about Vanderbilt University Medical Center’s Clinic for Transgender Health, where Dr. Shayne Sebold Taylor said outright that “these surgeries make a lot of money.”
