DOJ's confirmation that they are working on H1B-related civil rights cases should be welcome news to job-seekers across the United States who find themselves marginalized and disenfranchised by "H1B Only" job postings

President Donald Trump’s Department of Justice (DOJ) Civil Rights Division is investigating cases of discrimination involving the H-1B visa program, which enables foreigners to take jobs in this country away from hardworking Americans. The Department of Justice is openly accepting civil rights complaints from Americans regarding the H-1B program, the DOJ exclusively confirmed to PATRICK REPORTS.

“Through our Protecting U.S. Workers Initiative, the Civil Rights Division’s Immigrant and Employee Rights section has numerous open investigations into hiring practices that discriminate against American citizens, and the list continues to grow. We encourage anyone aware of such practices to notify the Civil Rights Division so we can determine if an investigation and enforcement action is needed,” Assistant Attorney General for Civil Rights Harmeet Dhillon told PATRICK REPORTS.

When I asked if there are currently open cases of alleged civil rights violations or complaints coming in from the public stemming from the H-1B program specifically, DOJ official Natalie Baldassarre told me, “I believe that is addressed in the statement, highlighted below.” She highlighted the section of Dhillon’s statement that reads “(DOJ) has numerous open investigations into hiring practices that discriminate against American citizens, and the list continues to grow.”

DOJ’s confirmation that they are working on H1B-related civil rights cases should be welcome news to job-seekers across the United States who find themselves marginalized and disenfranchised by “H1B Only” job postings, which hearken back to past discriminatory slogans from American history like “No Irish Need Apply.” But in the strip mall labor colony that modern America has largely become, it’s the immigrants who seem to get jobs and the native-born Americans who are getting shut out of society.

“The current H1B visa system is a scam that lets foreign workers fill American job opportunities. Hiring American workers should be the priority of all great American businesses. Now is the time to hire American,” tweeted Trump Commerce Secretary Howard Lutnick. But so far the administration is only considering replacing the “visa lottery” for foreign applicants with a process that will supposedly be more merit-based. Sadly, the administration is not signaling that they are prepared to shut the H-1B program down. At least not yet.

The H-1B visa program is capped at 85,000 NEW visas per year, but that doesn’t count the existing H1-B holders who can renew their visas. H-1B workers are essentially indentured servants, with their corporate employers controlling their status in the country. This allows corporations to treat visa workers more harshly than they would typically be allowed to treat American employees, thus giving foreigners an advantage in getting jobs.

When the @atlasgemini account on X tweeted out a list of “H1B Only” job postings on LinkedIn, investigative journalist Amanda Bartolotta said she would send the list to her contacts at DOJ, prompting Harmeet Dhillon to reply, “Please do.”

If you want to file a discrimination report to the DOJ, go to https://civilrights.justice.gov/ and maybe if the division gets flooded with truthful and accurate complaints then Dhillon will have enough justification to take action and defend herself against the liberal media.

The H-1B program is not the only visa program that shuts Americans out of the job market. The H-2B visa program for so-called “temporary” workers (many of whom work in the hospitality sector) is also out of control. H-2B visa holders can stay in the country for three years if they get their visas renewed, and then they have to leave the country for three months before they are allowed to come back for another potential three-year stint. Of course, the facts show that many visa holders overstay their invitation. 

As Patrick Reports recently noted: The legal cap on H-2B visas, as determined by Congress, is 66,000 per fiscal year. The government is allowed to hand out 33,000 H-2B visas for the fiscal year’s first half (which runs from October 1 to March 31) and another 33,000 for the fiscal year’s second half (which runs from April 1 to September 30.) U.S. Citizenship and Immigration Services (USCIS) officially announced that America hit the cap on H-2B visas for the second half of the fiscal year in late March 2025. But Biden is still rearing his ugly head.

On December 2, 2024, after Democrats lost the presidential election, the Joe Biden administration’s Department of Homeland Security (DHS) and Department of Labor sneakily put forth a rule allowing for 64,716 additional supplemental H-2B visas to be handed out to foreigners in fiscal year 2025, including 20,000 visas reserved for “nationals of El Salvador, Guatemala, Honduras, Haiti, Colombia, Ecuador, and Costa Rica,” according to USCIS.

Just weeks after the Trump administration hit its cap on congressionally-approved H-2B visas, the entrenched inspector general community went after Trump’s Labor Department, which processes the H-2B visas that USCIS eventually hands out.

DOL “assistant inspector general for audit” Laura B. Nicolosi sent an official engagement letter to DOL’s acting assistant secretary for employment and training administration Amy Simon and other Trump DOL officials on April 15, 2025. The engagement letter is entitled “Audit of ETA’s Backlog of H-2B Temporary Non-Agricultural Visa Program Applications, Project No. 06-P25-001-03-321.”

“Please be advised the Office of Inspector General is initiating an audit with the objective of determining whether the Employment and Training Administration (ETA) can demonstrate its corrective actions improved the processing of H-2B applications. We will contact your audit liaison to schedule a meeting to discuss the audit’s objective, scope, and methodology. We plan to begin work immediately after our meeting and would appreciate you notifying appropriate agency officials of our plans. We appreciate your cooperation in this matter and look forward to a successful review,” the letter states.

With the Swamp determined to get as many foreigners into the workforce as possible, it is  hopeful to see the Trump DOJ finally listening to the concerns of the native-born American victims of replacement migration. But citizen activists need to keep the pressure on the administration to make sure that the DOJ prosecutes cases of discrimination and sets a legal precedent that can be used to help non-visa workers compete in the crowded modern rat race. 

Perhaps a new civil rights movement in America is taking shape!
