An illegal alien with a disturbing immigration background and criminal history was captured by federal agents after he was released into a Virginia community despite committing a sex crime against a child.

Immigration and Customs Enforcement (ICE) just released footage and details of the apprehension, which occurred in Charlottesville on Sept. 25.

On that day, David Ambrosio-Herrera, a 36-year-old Mexican citizen, was convicted in Albemarle County Circuit Court of indecent liberties with a child under fifteen years old and sentenced to six years in prison followed by two years of supervised probation.

Incredibly, the judge presiding over the case then suspended Ambrosio-Herrera’s entire sentence and set him free.

ICE agents were waiting for the Mexican outside the courthouse and arrested him after a foot pursuit through downtown Charlottesville.

Ambrosio-Herrera illegally entered the U.S. in April 2007 but was caught by Border Patrol and voluntarily returned to Mexico.

Three days later, he again entered the U.S. illegally, was caught, and voluntarily returned to his home country.

He then slipped into the U.S. at an unknown location and date before being arrested in Charlottesville and convicted of identity theft in 2014.

In January 2017, Ambrosio-Herrera was arrested in Albemarle County and charged with five counts of perjury.

ICE entered the Mexican into removal proceedings at that time, but he apparently remained in the U.S. for many more years.

In May 2024, a federal immigration judge ordered Ambrosio-Herrera removed from the country.

On Oct. 25, 2024, Ambrosio-Herrera was arrested for exposing himself to a child at a bus stop in Charlottesville.

“David Ambrosio Herrera is a serial criminal illegal alien and a convicted child sex offender. He is exactly the kind of person we aim to remove from the United States,” said ICE Washington, D.C. Enforcement and Removal Operations acting Field Office Director Joseph Simon.

“He has illegally reentered the country multiple times, has prior criminal convictions and should have never been here to traumatize this child.”
