Eight migrants can now be deported to South Sudan after a last-ditch legal request was denied by a judge on Friday.
The migrants, who were scheduled to be flown to South Sudan on Friday at 7pm EST and are currently being held on a US military base in Djibouti, had filed new claims in Washington on Thursday after the Supreme Court ruled that a Boston district judge could no longer require the Department of Homeland Security to hold them.
Two courts considered their claims on a day when courts are normally closed to celebrate Independence Day.
The men have all been convicted of serious crimes, the Department of Homeland Security says, with four being convicted of murder.
The new ruling comes after months of legal wrangling over the fate of the men.
US District Judge Brian Murphy, in Boston, blocked the government from deporting the men to South Sudan after he found, in May, that officials had violated his earlier ruling in a class-action suit on the due-process rights of migrants. That earlier ruling, in April, had blocked the Trump admin from sending migrants to “third countries” to which they have no ties without first giving them the right to raise safety concerns.
On 23 June, the Supreme Court put Judge Murphy’s April order on hold, only for Murphy to say the Court’s decision did not apply to his May ruling.
The Justice Department decried Murphy’s stance as a “lawless act of defiance” and asked the Supreme Court to intervene again. On Thursday, it sided with the Trump administration and said its decision also applies to Murphy’s May order as well.
