Donald Trump celebrated Tuesday after the Georgia Supreme Court ruled in favor of a lower court’s decision disqualifying Fulton County District Attorney Fani Willis from prosecuting her fraudulent RICO case against the US president.
CNN reports Tuesday’s 4-3 ruling “backed an appeals court’s decision to disqualify Willis in December 2024 over her romantic relationship with the special prosecutor she appointed to the case.”
The decision, which turns the case over to the Prosecuting Attorneys’ Council in Georgia, means the case could effectively be halted indefinitely or thrown out entirely.
President Trump lauded the Georgia Supreme Court’s decision on Truth Social, writing:
BREAKING NEWS! In a Big WIN for Justice and Law in Georgia, the Georgia Supreme Court just ruled that District Attorney Fani Willis and her “team” of Weaponized Prosecutors are DISQUALIFIED, once and for all, from the Fake Witch Hunt against me, and many other Great American Patriots, people that were treated so unfairly, and indeed, viciously. Willis and her lover, Nathan Wade, who she hired even though he was completely unqualified and had never prosecuted such a case before, blatantly lied, under oath, about their torrid “love” affair, the ridiculous amounts of money she paid him, their Caribbean vacations together, her clear Campaign Finance violations, unlawfully taking money from the honest Taxpayers of Georgia, and, most importantly, about their obsession with doing anything and everything they can to “GET TRUMP,” which included destroying the lives of many other people. While a trial court had let Willis stay on the case despite evidence of impropriety, an appeals court later reversed the decision, the New York Times reports.
Penning the Supreme Court’s majority opinion, Justice Andrew Pinson noted the appeals court’s ruling “does not raise a question of gravity that warrants our further review.”
Dissenting Justice Carla Wong McMillian, a Republican, sought legal clarification on the issue, arguing the case sets a precedent regarding “whether an attorney can be disqualified based on the appearance of impropriety alone,” and affects “every single active lawyer in the State of Georgia.”
In a statement to the NY Times, Willis wrote:
“While I disagree with the decision of the Georgia Court of Appeals and the Georgia Supreme Court’s divided decision not to review it, I respect the legal process and the courts…Accordingly, my office will make the case file and evidence available to the Prosecuting Attorneys’ Council for use in the ongoing litigation. I hope that whoever is assigned to handle the case will have the courage to do what the evidence and the law demand.”
Trump lawyer Steve Sadow also praised Tuesday’s ruling, label Willis’ case against the president “lawfare”:
“Willis’ misconduct during the investigation and prosecution of President Trump was egregious and she deserved nothing less than disqualification… This proper decision should bring an end to the wrongful political, lawfare persecutions of the President.”
